Consumer Guarantees Act 1993

Our warranty operates alongside any rights and remedies to which you may be entitled under the Consumer Guaranties Act 1993 (CGA) and any other New Zealand law that applies to the products.  To avoid doubt, our warranty does not affect or limit any rights you may have under the CGA.

The CGA is legislation that outlines the guarantees and rights of both the seller and consumer for products and services sold:

At any time before or after expiry of our warranty you are entitled to exercise rights you may have under the CGA against us.

Minor fault

If our product does not meet one of the guarantees detailed above or cannot be repaired within a reasonable period of time, we will either repair or replace the product with an identical product type.  In the event a repair or replacement is not a viable option, or the repair cannot be carried out within a reasonable period of time, we will refund you the original purchase price.

Major fault

In the event the product cannot be repaired, due to the nature of the fault (safety risk) or the failure is of substantial character (i.e. multiple product failures), you may choose either a replacement or an identical product type or a refund of the original purchase price (excluding the purchase of services).

Commercial or business

The CGA may not apply to products and services purchased from us for commercial, resale or trade use.  If you are purchasing products or services for business purposes, as defined in sections 2 and 43 of the CGA, you agree that the consumer guarantees provided for in the CGA will not apply to the supply for those products or services.

Privacy disclosure

In order to seek a remedy under the CGA we may need to collect and share your personal information for the purposes of conducting a repair service with a third-party repair provider or supplier.  This may include your contact information, such as name, telephone number, email and residential address.

Remer understand your personal information is confidential and we are committed to protecting your privacy in accordance with the Privacy Act 1993.

Remer’s warranty is governed by the laws of New Zealand and by purchasing our products, you submit to the non-exclusive jurisdiction of the New Zealand courts in respect of all matters relating to this warranty.  None of the above affects your rights under New Zealand consumer legislation, including the CGA, and you may invoke these rights at any time.
